Presiding Judge, Justice S.E. Aladetoyinbo of Abuja High Court has discharged and acquitted former President of the Senate, Senator AdolphusWabara, and two others of allegations of bribe for budget leveled against them by the Federal Government in 2005.The two others who were set free by the court are Ibrahim Abdulazeez and John AzutaMbata, all former senators.
The Presiding Judge in his ruling discharged the defendants under Section 355 of the Administration of Criminal Justice Act 2015; stating that fourteen years down the line, the suit lacked witnesses to prosecute the charge. The Administration of Criminal Justice Act 2015 in Section 355 states as follows; “where a complainant at any time before a final order is made in a case satisfies the court that there are sufficient grounds for permitting him to withdraw his compliant, the court may permit him to withdraw the compliant and shall thereupon acquit the defendant.
It will be recalled that Rt. Hon. AdolphusWabara was Senate President between 2003 and 2005 was charged alongside Hon. GarbaMatazu and Prof. Fabian Osuji former member of the House of Representatives and Minister of Education respectively were dragged to court by the Independent Corrupt Practices and other related Offences Commission (ICPC) over N50million budget corruption charges.
